Kohana Professional

TERMS OF USE

2nd October, 2026.

These Terms of Use (“Terms”) govern access to and use of the Kohana Online Academy website, online courses, training materials, videos, assessments, certificates and related digital services (“Academy”).

The Academy is operated by Kohana Professional, Ireland (“Kohana”, “we”, “us” or “our”).

By purchasing a course, creating an account or accessing the Academy, you agree to these Terms.

Nothing in these Terms limits or excludes any rights or remedies that you may have under applicable Irish or European Union consumer law.

1. About Kohana Online Academy

Kohana Online Academy provides online education and professional training, primarily within the nail and beauty industry.

Course content may include educational videos, written lessons and training materials, demonstrations, downloadable resources, assessments or quizzes, practical guidance and certificates of completion.

The exact content and requirements of each course are described on the relevant course page.

2. Eligibility and Account Registration

You must provide accurate and complete information when creating an Academy account or purchasing a course.

Your account is personal to you. You must not share your login details with another person, allow another person to complete a course or assessment using your account, purchase one course for use by multiple students unless we have expressly agreed to this in writing, or attempt to gain unauthorised access to another user's account or restricted areas of the Academy.

You are responsible for maintaining the confidentiality of your account credentials.

If we reasonably believe that an account is being shared, misused or used in breach of these Terms, we may temporarily suspend access while the matter is investigated.

3. Course Access

Unless otherwise stated on the relevant course page, students receive access to their purchased online course for 12 months from the date of enrolment.

The course must be completed within this access period. After the access period expires, access to the course, videos, assessments and other course materials may automatically end.

Any extension of access is at Kohana's discretion unless an extension is required by applicable law or has otherwise been agreed in writing.

4. Course Completion and Certification

Students must complete the requirements specified for the relevant course before a certificate can be issued.

Where a course includes a final assessment, students must achieve the required pass mark stated for that course. Where the course requires a 100% assessment result, all questions must be answered correctly before the course is considered successfully completed.

Students may retake an assessment where this option is provided within the course.

A certificate will only be issued once all required course components and assessments have been successfully completed.

Certificates confirm successful completion of the relevant Kohana Online Academy course. They do not automatically constitute a professional licence, government qualification or permission to perform a regulated activity unless this is expressly stated in the course description.

Students are responsible for checking any professional, insurance, licensing or regulatory requirements applicable to them in the country or jurisdiction in which they intend to work.

5. Educational and Professional Responsibility

The Academy provides educational and professional training materials.

Students are responsible for applying the techniques taught appropriately, safely and within the limits of their own training, competence and applicable professional requirements.

Students must follow relevant health and safety procedures, manufacturer instructions and applicable laws and professional standards.

Completion of a course does not remove the student's responsibility to exercise appropriate professional judgement when providing services to clients.

6. Prices and Payment

Course prices are displayed before purchase and will include applicable taxes where required by law.

The total amount payable will be shown before you complete your purchase.

Payment must be successfully completed before access to a paid course is provided, unless otherwise expressly agreed.

Any promotional offer, discount or promotional code is subject to the conditions stated with that promotion.

7. Consumer Right to Cancel

If you purchase a course online as a consumer, you may have a statutory right to withdraw from the contract within 14 days, subject to applicable Irish and European Union consumer law.

Where you request or expressly agree that access to digital content or digital services begins during the withdrawal period, your cancellation rights may be affected in accordance with applicable law.

Where required by law, we will obtain the appropriate acknowledgement or consent before supplying digital content in circumstances where commencing supply affects the statutory right of withdrawal.

Nothing in these Terms removes or restricts any statutory cancellation, refund or other consumer right that cannot lawfully be excluded.

To exercise a statutory right of withdrawal, please contact Kohana using the contact details provided on our website.

8. Refunds and Statutory Remedies

Refund requests will be handled in accordance with applicable Irish and European Union consumer law.

If digital content or a digital service supplied by us does not conform to the contract or does not operate as legally required, you may be entitled to statutory remedies.

Depending on the circumstances, these may include bringing the digital content or service into conformity, a proportionate price reduction, termination of the contract or a refund.

Nothing in these Terms affects your statutory rights.

9. Intellectual Property

All Academy content is owned by or licensed to Beauty Vision Ltd / Kohana Professional and is protected by applicable copyright, trademark and intellectual property laws.

This includes course videos, photographs, graphics, written materials, manuals, presentations, demonstrations, course structures, assessments and questions, downloadable resources, branding, logos and educational materials.

When you purchase a course, you receive a limited, personal, non-exclusive and non-transferable right to access and use the course for your own education.

Purchasing a course does not transfer ownership of any Academy content or intellectual property to you.

10. Prohibited Use of Course Materials

Without our prior written permission, you must not copy, reproduce or redistribute course materials; record, screen-record or download videos except where a download option is expressly provided; screenshot substantial portions of course materials for redistribution; share course videos, manuals or other materials with another person; upload Academy materials to social media, websites, file-sharing services, cloud storage or other platforms for third-party access; sell, sublicense or commercially distribute Academy materials; reproduce

Kohana course content within your own training programme; use our materials to create or substantially reproduce another course, manual or educational programme; remove copyright, trademark or other proprietary notices; or provide another person with access to your Academy account.

Unauthorised copying or distribution may constitute an infringement of our intellectual property rights.

11. Technical Requirements

Students are responsible for having suitable equipment, internet access, software and a compatible device or browser necessary to access the Academy.

We will take reasonable steps to maintain availability of the Academy but cannot guarantee that access will be uninterrupted at all times.

Temporary interruptions may occur due to maintenance, updates, third-party hosting services, internet outages or circumstances outside our reasonable control.

If a technical issue with the Academy prevents you from accessing purchased content, please contact us so that we can investigate and, where required, provide an appropriate remedy.

12. Course Updates and Changes

We may update course materials from time to time to improve educational quality, accuracy, safety, regulatory compliance or technical functionality.

We may make reasonable changes to course presentation, lesson order, materials or platform functionality provided that such changes do not materially reduce the course that you purchased.

Where a material change affects an existing student's contractual rights, we will comply with applicable consumer law.

13. Availability of Products and Techniques

Some Academy courses may demonstrate Kohana Professional products, equipment or techniques.

Product ranges, formulations, packaging, availability and professional guidance may change over time.

Students should always follow the current product instructions and safety information applicable to the product being used.

14. Third-Party Services and Links

The Academy may use or link to third-party services, including payment providers, video hosting services and learning-management technology.

Third-party websites and services may be governed by their own terms and privacy policies.

We are not responsible for independent third-party websites or services except to the extent that responsibility cannot lawfully be excluded.

15. Suspension or Termination of Access

We may suspend or terminate a student's Academy access where there is reasonable evidence of serious or repeated breach of these Terms, including account sharing, unauthorised copying or distribution of course materials, fraudulent activity, attempts to circumvent Academy security, intellectual property infringement or misuse of the Academy.

Where appropriate, we may first contact the student and provide an opportunity to resolve the issue.

Any suspension or termination will be exercised reasonably and in accordance with applicable law.

16. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts your statutory rights under Irish or European Union consumer law.

To the extent permitted by law, Kohana is not responsible for losses resulting from a student's failure to follow course instructions, health and safety requirements, product instructions or applicable professional standards.

Students remain responsible for how they apply the knowledge and techniques learned through the Academy in their own professional practice.

17. Privacy and Personal Data

Personal data collected through the Academy will be processed in accordance with our Privacy Policy and applicable data protection law, including the General Data Protection Regulation (GDPR) and applicable Irish data protection legislation.

Please review our Privacy Policy for information about how we collect, use, store and protect personal data and about your data protection rights.

18. Changes to These Terms

We may update these Terms where reasonably necessary, including to reflect changes to our services, applicable law, regulatory requirements or Academy functionality.

The version applicable to your purchase will not be retrospectively changed in a way that unlawfully reduces your contractual or statutory rights.

The current version of these Terms will be published on the Academy website with the date of the latest update.

19. Governing Law

These Terms are governed by the laws of Ireland.

If you are a consumer resident in another EU or EEA country, you may also benefit from mandatory consumer protections applicable in your country of residence where those protections apply by law.

Nothing in this clause deprives a consumer of mandatory rights or protections that cannot legally be excluded by agreement.
